Your Rights as a Home Care Patient
Magic Home Care LLC · New York State licensed home care services agency (LHCSA)
As a patient of a licensed home care services agency in New York State (10 NYCRR 766.1), you have the right to:
1. Be informed of these rights, and to exercise them, before care begins. If you are unable to, your family or guardian may exercise them for you.
2. Be given a statement of the services available from the agency and the charges for them, including which charges may not be covered by Medicaid, Medicare or other insurance.
3. Be told, in advance, the name and job title of each person caring for you.
4. Participate in planning your care and in any changes to your plan of care, and to be told in advance of any change.
5. Refuse care or treatment after being fully informed of, and understanding, the consequences of refusing.
6. Be treated with consideration, respect and dignity, including privacy in treatment and in care for your personal needs.
7. Receive care without discrimination because of race, color, national origin, religion, creed, sex, sexual orientation, gender identity, age, disability, marital status or source of payment.
8. Have your records and all information about you kept confidential, and to approve or refuse their release to anyone outside the agency except as required by law or third-party payment contract.
9. Express complaints about the care and services you receive, or fail to receive, and about the lack of respect for your property by anyone providing services on behalf of the agency — and to have the agency investigate your complaint. You may complain without fear of discrimination or reprisal.
10. Be informed of the agency's procedures for voicing complaints, and of the New York State Department of Health Home Care Hotline: 1-800-628-5972.
11. Be informed of the agency's policy on advance directives (health care proxy, living will, do-not-resuscitate orders) and to have your wishes respected.
12. Be told of any financial benefit the agency has in referring you to another provider.
13. Be informed, in writing, of the agency's policies on discharge or transfer and to receive advance notice.
